Judge Overturns Sales Injunction on Samsung Galaxy Tab 10.1

Samsung were none too pleased when a California Judge banned the sale of the Galaxy Tab 10.1 in the US in the aftermath of the
Apple infringement trial. However, the South Korean company can now turn that collective frown upside down as Judge Lucy Koh has now overturned her own ban on the device after the California Court of Appeals came to the conclusion that the Tab 10.1 does not actually infringe on the patents that Apple claimed it did.
Samsung released a statement on the events, saying “we are pleased with the court’s action today, which vindicates our position that there was no infringement of Apple’s design patent and that an injunction was not called for.”
Apple could now be held responsible for what was essentially a wrongful accusation that led to the sales injunction. Time will tell if Samsung will pursue this matter, which they certainly have the right to do.
